NYC Housing Court Glossary

Holdover Proceeding

Plain EnglishYour landlord wants you out, not just paid

Legal Definition

A court case brought by a landlord to evict a tenant whose lease has expired, or who has allegedly violated their lease. Different from a nonpayment case — the landlord wants you out.

💡
Practical Tip

Holdovers are more complex than nonpayment cases. Notice defects, succession rights, and Good Cause Eviction are all powerful defenses here.
